Emergency Calling Notice of 911 and E911 Service Limitations

This Emergency Calling Notice ("Notice") supplements the Master Services Agreement ("MSA") between Tarionix LLC ("Tarionix") and the Customer. Capitalized terms not defined herein have the meanings set forth in the MSA.

Federal and state regulations require providers of certain interconnected VoIP services to inform customers of the capabilities and limitations of emergency calling. By using Tarionix voice and communications services, Customer acknowledges that it has read and understands this Notice and agrees to communicate these limitations to all users of the services.

1. Differences from Traditional 911

Tarionix voice services may not operate in the same manner as traditional landline 911 or enhanced 911 (E911) services provided by local telephone companies. Routing, callback information, and automatic location information may be limited depending on the service configuration.

2. Internet and Power Dependency

Emergency calling depends on a functioning internet connection, compatible equipment, and electrical power. If connectivity or power is interrupted, emergency calling may be unavailable.

3. Network Conditions

Network congestion, maintenance activities, latency, or service interruptions may delay or prevent emergency calls from reaching the appropriate emergency response center.

4. Customer Location Information

Customer is responsible for maintaining accurate service location information for every user, device, extension, softphone, and handset. Address changes should be promptly communicated to Tarionix using the designated support process.

5. Location Update Delays

Changes to registered emergency service locations may require time to propagate through third-party emergency service databases. During this period, emergency responders may receive outdated location information.

6. Telephone Number Limitations

Use of telephone numbers associated with geographic regions different from the user's physical location may affect routing of emergency calls and may delay emergency response.

7. Alternate Routing

During outages, exceptional call volumes, or other operational events, emergency calls may be routed to alternate emergency call centers or administrative numbers before reaching the appropriate Public Safety Answering Point (PSAP).

8. Softphone Services

Emergency calls placed using softphone or software-based clients may rely on the registered service address rather than the user's real-time physical location. Users should verify location information before relying on such services.

9. Extension-Only Devices

Certain extension-only devices, shared appearance phones, common area phones, or similar configurations may present only the primary registered service location to emergency responders rather than the caller's precise location.

10. International Services

International telephone numbers and services may not support local emergency numbers such as 911, 999, 112, or equivalent emergency services depending on the jurisdiction.

11. Customer Responsibilities

Customer agrees to notify employees, contractors, visitors, and other users of these limitations and to maintain an alternative means of contacting emergency services whenever appropriate.

12. Acknowledgement

By using Tarionix voice services, Customer acknowledges that emergency calling services have inherent technical limitations and accepts responsibility for maintaining accurate location information and appropriate contingency measures.
